EsNtion Sues Jones International, LTD
EsNtion Records, Inc., distributed by 3MD/Ryko (WEA), is a Chicago based dance and Latin record label that has filed suit against Jones International, Ltd. headquartered in Centennial, CO and one of their subsidiary companies, JonesTM, Inc. formerly known as TM Century, which is headquartered in Dallas, TX.
EsNtion is the home of such popular artists as Danielle Bollinger, Tricky Bizzniss (featuring the former lead singer of The Crystal Method, Trixie Reiss), The Lake Street Project, Fruehbel, Grupo Fuego, La Tira, P-1 and many more.
EsNtion music has charted on Billboards' dance related charts and has been featured in films, on television and in commercials. Most recently, P-1's Digital Lover was used in an episode of Disney's Samantha Who, airing on ABC in the US.
EsNtion alleges that Jones commercially released approximately 30 compilations, totaling approximately a quarter million units, that featured EsNtion artists and titles and did so without any permissions or licenses being issued. Furthermore, EsNtion alleges that Jones released all of these titles to radio stations internationally, an act which EsNtion alleges severely damaged their ability to license the materials overseas since the songs were all exploited without EsNtion's knowledge and prior to EsNtion having the ability to place any product in each market to sell.
The suit, filed on December 4, 2007 by attorney Wendy B. Mills in the United States District Court for the Northern District of Texas Dallas division, contains other allegations concerning trademark violations and non-payment of mechanical royalties.
